1. Who we are
These Terms of Use ("Terms") govern your use of the websites and apps branded ItsForSale (the "Service").
The Service is operated by:
- Name: Keith Patrick McCann
- Trading as / brand: ItsForSale
- Address:
- Email:
- Phone:
In these Terms, "we", "us" and "our" mean the operator above. "You" means the person using the Service. Full details: Contact / Imprint.
2. Our role: we are a classifieds host, not the seller
Important. ItsForSale is a classified listing service. We provide tools for users to post and browse ads. We are not a party to any sale, gift, swap or hire between users. We do not offer on-platform checkout, escrow or payment for goods. Arrangements to buy, sell, meet, pay or collect happen off the Service between you and the other user.
Unless we clearly say otherwise in writing for a specific feature:
- we do not own, inspect, guarantee or take title to items listed;
- we do not verify every user's identity, honesty or legal capacity;
- we do not guarantee that a listing is accurate, available or lawful;
- we do not provide "safe payment", buyer protection or seller guarantees for deals between users.
Please read our Safety Centre before meeting anyone or paying for an item.
3. Accepting these Terms
By creating an account, posting a listing or otherwise using the Service, you agree to these Terms, our Privacy Policy, Cookie Policy and Community Guidelines (including the prohibited items list). If you do not agree, do not use the Service.
4. Eligibility and accounts
- You must be at least 18 years old to create an account or post listings.
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your login details secure and for activity under your account.
- One person should not create multiple accounts to evade bans, limits or fees (if any).
- We may refuse, suspend or close accounts that break these Terms or the law.
5. Listings and user content
When you post a listing or other content (text, photos, location, contact details), you confirm that:
- you own the item or have clear authority to advertise it;
- the listing is truthful and not misleading;
- you will not advertise illegal, stolen, counterfeit or otherwise prohibited items (see Prohibited items);
- you will not include other people's personal data (photos of identifiable people, IDs, phone books, etc.) without a lawful basis;
- your content does not infringe copyright, trademarks or other rights.
You grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute your listing content solely to operate, promote and improve the Service (for example showing ads in search results or previews). You keep ownership of your content.
We may edit, refuse, delist or remove content that appears to break these Terms, our guidelines or the law. We are not obliged to pre-screen every listing.
6. Private sellers vs business / trader sellers
Most listings on ItsForSale are expected to be from private individuals. If you sell as a business or trader, you must declare that when posting (or as soon as the feature is available) and follow the Irish and EU trader rules that apply to you.
We may show a "private" or "business" label based on your declaration. We do not independently verify every declaration. Misrepresenting a business as a private sale may breach consumer law and these Terms.
7. Consumer rights: private sales vs trader sales
Buyer beware on private sales. For typical private (person-to-person) sales, the EU and Irish online consumer cooling-off rights and statutory remedies that apply to purchases from traders usually do not apply. Inspect before you pay. Prefer cash on collection for local deals.
If the seller is a business or trader, consumer law may apply to that seller's contract with you, not automatically to us as the host. Ask for receipts and their returns policy. Because we do not run on-platform checkout, contracts are formed between users off the Service.
Nothing in these Terms limits rights that cannot be excluded under Irish law.
8. Prohibited use
You must not use the Service to:
- break Irish or EU law, or advertise illegal goods or services;
- scam, defraud, harass, threaten or dox anyone;
- post spam or malware links, or scrape the Service without permission;
- interfere with security, rate limits or other users' access;
- abuse the report tool with knowingly false complaints;
- sell or advertise items on our prohibited list.
9. Moderation, reporting and illegal content
As a hosting / online platform-type service under the EU Digital Services Act (DSA), we provide a way to report illegal or prohibited content. Use the Report option on a listing where available, or email us (see Contact), and include:
- the ad link or ID;
- the reason (illegal item, scam, IP infringement, privacy, hate, etc.);
- any evidence you have.
We aim to acknowledge reports and act diligently, without undue delay, on notices of illegal content. If we restrict or remove your content, we will tell you why in plain language and how to contest it, except where the law requires otherwise.
We may suspend repeat offenders and accounts that abuse reporting. For serious crime (weapons, drugs, child sexual abuse material, clear fraud rings) we may report to An Garda Síochána. More detail: Safety Centre, how to report.
10. Our intellectual property
The Service design, logos, software and original text (other than user listings) belong to us or our licensors. You may not copy, scrape, reverse engineer or reuse them except as needed to use the Service normally, or with our prior written permission.
11. Service availability and changes
We provide the Service on an "as is" and "as available" basis. Features may change, pause or end. We may introduce paid options later (for example featured listings); those will have clear pricing and terms before you buy.
If we rank or recommend listings, the main parameters may include relevance, recency, distance/location and (if offered) paid boost. We will keep a plain-language note of ranking factors when search and recommendation features are live.
12. Liability
To the fullest extent permitted by Irish law:
- we are not liable for deals between users, item quality, non-delivery, payment disputes or meet-up incidents;
- we are not liable for user content that we host without actual knowledge of illegality, or that we remove promptly once we become aware (subject to DSA hosting rules);
- we exclude liability for indirect or consequential loss, loss of profit or loss of data arising from use of the Service.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that Irish law does not allow us to exclude. If you are a consumer using the Service for personal use, your mandatory statutory rights are not affected.
13. Suspension and termination
You may stop using the Service and request account deletion at any time (see Privacy Policy). We may suspend or terminate access if you seriously or repeatedly breach these Terms, the Community Guidelines or the law, or if we need to protect users or the Service.
14. Changes to these Terms
We may update these Terms. The "Effective" date at the top will change. Material changes will be notified in-app, by email or via a notice on the Service where practical. Continued use after the effective date means you accept the updated Terms, except where Irish law requires a different process.
15. Governing law and disputes
These Terms are governed by the laws of Ireland. Irish courts have jurisdiction, without prejudice to any mandatory consumer protections that may allow you to bring proceedings in your country of residence if you are an EU consumer.

Not legal advice. This Terms of Use page is a practical draft for an Irish classifieds host. It is not a solicitor's opinion. Have it reviewed by an Irish solicitor before wide promotion, and update it if you add checkout, escrow or other marketplace features.
